Plain version: buy a licence, use it on your own machines, don’t redistribute it. Pre-orders can be cancelled for a full refund at any time before the software is delivered to you. Nothing here takes away a right you have by law.
These Terms govern your use of ohlamix.com, the OHLA applications and plug-ins, and anything you buy from us. Using the site or buying a product means you accept them.
OHLA LLC is a company based in Philadelphia, Pennsylvania, United States. We make opto-haptic control technology: software that shows and lets you feel what is happening in audio, and reference hardware built on the same ideas. Reach us at mia@ohlamix.com.
When you buy OHLA software you are buying a licence to use it, not the software itself. The licence is personal to you or to your company, it does not expire, and it covers the machines you work on.
Some products on this site are offered as pre-orders, which means you pay now and the product is delivered when it is finished. Where that is the case it is stated plainly on the product before you buy, together with the delivery window we expect to meet.
You can cancel a pre-order at any time before it is delivered, for a full refund, for any reason or none. Email mia@ohlamix.com and we will return the payment to the card you used.
If we are going to miss the stated delivery window, we will tell you by email and give you the choice of waiting or taking a full refund. If we cannot deliver at all, we refund you without being asked.
Prices are in United States dollars. Payments are taken by Stripe, which handles the card details directly — OHLA never receives or stores your card number. What we receive is the fact of a successful payment, your email address, and any delivery address you give for physical goods.
Any sales tax that applies is calculated at checkout and shown before you pay. Prices can change, but never for an order already placed.
Software is delivered by email to the address used at checkout, as a download and, where a product needs one, a licence key. If it has not arrived when expected, check the spam folder first and then write to us — we will resend it.
Hardware is shipped to the address given at checkout. Risk passes to you on delivery.
Refunds are covered in full on the refund and cancellation policy, which forms part of these Terms.
Each product lists its current system requirements before you buy. Plug-in formats, supported processors and host compatibility are stated on the product itself, because they change as the software develops. If a product will not run on your system and we cannot get it running, you are entitled to a refund under the refund policy.
The OHLA name, the wordmark, the interface designs, the colour system and the underlying methods are owned by OHLA LLC. The technology is the subject of filed patent applications. Buying a licence gives you the right to use the software; it transfers nothing else.
Field-of-use and manufacturing licences are separate agreements and are not granted by anything on this site. Write to mia@ohlamix.com.
Audio you run through OHLA software is yours. We do not receive it, store it or claim any right in it, and we claim nothing in the recordings or mixes you make using it.
You agree not to use the site or the software to:
We give the software and the site to you as they are. We do not promise they will be uninterrupted, error-free, or fit for a particular purpose, and to the extent the law allows we disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing here excludes a warranty or a right that cannot lawfully be excluded. Some states do not allow these exclusions, so some of this may not apply to you.
To the fullest extent the law allows, OHLA LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost revenue or lost data, arising out of your use of the site or the software.
Our total liability for any claim relating to a product is limited to what you paid us for that product.
You can stop using the software at any time. We may end a licence if it is being redistributed or otherwise used in serious breach of these Terms; we will write to you first and give you a chance to put it right, unless the breach makes that unreasonable.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Disputes belong to the state and federal courts sitting in Philadelphia County, Pennsylvania.
We may update these Terms. The effective date at the top of the page changes when we do, and the version in force for your order is the one published when you placed it.
